Terms and Conditions

These Terms and Conditions ("Agreement") govern the use of PA equipment rental service provided by Hills Rental ("Company"). By accessing or using our PA equipment rental services, you agree to be bound by these Terms and Conditions. 

1. Rental Agreement
By renting the products from us, the renter (hereafter referred to as “Customer”) agrees to all terms and conditions outlined below. This agreement consitude a legally binding contract between you and the Company.

2. Rental Period
The rental period begins at the time of equipment collection or delivery and ends at the agreed return date and time. Extensions must be requested in advance and are subject to availability and additional charges.

3. Rental Charges
Rental fees must be paid in full prior to or at the time of collection/delivery. Additional fees may apply for late returns, damaged equipment, or equipment that is not returned. A security deposit may be required, refundable upon the return of equipment in good working condition.

4. Delivery and Pickup
Delivery and pickup services may be available at an additional cost. It is the Customer's responsibility to ensure safe and accessible delivery and pickup locations. If the equipment is not ready for pickup at the agreed time, additional charges may apply.

5. Use of Equipment
The Customer agrees to use the equipment in a safe and responsible manner and only for its intended purpose. The equipment must not be altered or modified in any way. Only qualified personnel should operate the equipment, and the Customer is responsible for ensuring proper setup and usage.

6. Damage and Loss
The Customer is fully responsible for any loss or damage to the equipment during the rental period, regardless of fault. Damaged or lost equipment will be repaired or replaced at the Customer’s expense, which may exceed the security deposit. The Customer must report any malfunction, damage, or theft immediately to the Company.

7. Faulty Equipment
The Company ensures that all equipment is tested and in working order before rental. In the event of equipment malfunction or failure, the Customer must notify the Company immediately for a resolution, which may include repair or replacement of the equipment. The Company is not responsible for any damages, injuries, or losses resulting from the malfunction or failure of rented equipment, except where the Company has been proven negligent in maintaining the equipment. In cases where faulty equipment causes damage, the Company’s liability is limited to the replacement or repair of the equipment and any rental fees paid.

8. Inspection and Return
The Customer agrees to return the equipment in the same condition as it was rented, normal wear and tear excepted. Equipment will be inspected upon return. Any damages, missing parts, or excessive cleaning required will incur additional charges.

9. Liability
The Company is not liable for any injury, damage, or loss caused by the use of the rental equipment, except as outlined under "Faulty Equipment." The Customer assumes all risks associated with the use of the equipment, including the risk of injury or property damage. The Customer agrees to assume full responsibility for any claims, actions, damages, liabilities, or costs, including third-party claims, arising from the use of the rented equipment. The Company is not liable for any damage, injury, or loss suffered by third parties as a result of the equipment being rented or used by the Customer.

10. Cancellations and Refunds
Cancellations made at least 48 hours prior to the rental date will be eligible for a full refund. Cancellations made less than 48 hours before the rental date may be subject to a cancellation fee. No refunds will be given for early returns or unused equipment.

11. Force Majeure
The Company is not liable for delays, cancellations, or failure to perform due to causes beyond its reasonable control, such as natural disasters, acts of government, or strikes.

12. Indemnification
The Customer agrees to indemnify and hold harmless the Company from any claims, damages, or losses arising out of the use of the rental equipment. This includes any third-party claims for injury or damage resulting from the Customer’s actions or the misuse of the rented equipment.

13. Security Deposit
A security deposit may be required at the time of booking or before equipment collection. The security deposit will be refunded upon the return of the equipment in the same condition, subject to inspection for any damages or loss.

14. Jurisdiction
This agreement shall be governed by the laws of new South Wales. Any disputes arising from the rental agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales.

15. Entire Agreement
These terms and conditions constitute the entire agreement between the Customer and the Company, superseding any prior agreements or communications.
